1. Acceptance and scope
These Terms of Service (“Terms”) govern your use of westhavenassets.com and your communications with Westhaven Private Limited (“West Haven”, “we”, “us”, or “our”) through this website. By using the website or submitting an enquiry, you agree to these Terms and our Privacy Policy.
These Terms apply to the website and preliminary discussions. A service is not engaged, and West Haven is not obliged to begin work, until the relevant scope, fees, approvals, and other terms are confirmed in writing. If a signed proposal, work order, or service agreement differs from these Terms, that document controls for the relevant service.
2. Website information and no guarantee of engagement
The website describes the kinds of support we may offer in Thiruvananthapuram and surrounding areas. It is general information, not legal, tax, medical, engineering, investment, valuation, or other professional advice. Descriptions, availability, service areas, response times, and pricing may change and are subject to assessment of the relevant property, people, documents, safety conditions, and operational capacity.
Submitting a form, booking a consultation, or communicating with us does not create a client relationship, guarantee an outcome, reserve availability, or obligate either party to enter a service agreement.
3. Services and scope
West Haven may provide or coordinate property and asset care, tenant and short-stay management, construction project-management support, real-estate assistance, and elderly and family support. The specific deliverables, visit frequency, reporting, access arrangements, pricing, vendor role, and exclusions for each engagement will be set out in writing.
For construction support, West Haven's role is limited to the scope agreed with the client. Unless expressly stated otherwise in writing, West Haven does not take the construction contract or replace the responsibilities of architects, structural engineers, contractors, statutory authorities, or other licensed professionals.
4. Important service limitations
Elderly and family support is practical assistance and companionship. It is not emergency response, ambulance service, nursing, medical diagnosis, treatment, legal representation, financial advice, or a substitute for a qualified professional. In an emergency, contact local emergency services and the appropriate medical or public authority first.
Property inspections, reports, tenant support, real-estate assistance, construction monitoring, and vendor coordination are carried out within the agreed scope. They are not a guarantee of property condition, rent, occupancy, investment returns, title, legal validity, construction performance, vendor performance, timing, or sale outcome. Where specialist advice is needed, we may recommend that you consult a qualified professional.
5. Your responsibilities
To enable us to work safely and properly, you must provide accurate and current information, disclose material risks and relevant conditions, obtain any permissions or authority needed for us to act, and give timely instructions and approvals. You are responsible for ensuring that information, access instructions, documents, and materials you provide do not infringe another person's rights or violate applicable law.
You must not ask us to perform unlawful, unsafe, deceptive, or unauthorised work. We may pause, refuse, or escalate an instruction where we reasonably believe it is unlawful, unsafe, beyond our agreed scope, or requires specialist input or additional authority.
6. Estimates, fees, expenses, and approvals
Quotes, estimates, package descriptions, and indicative prices are subject to written confirmation and may depend on inspection, scope, third-party costs, taxes, and site conditions. Applicable taxes, including GST where chargeable, will be addressed in the relevant invoice or proposal.
Our working principle is that additional expenses require your prior approval. The exact approval process, any pre-authorised emergency limit, payment schedule, consequences of delayed payment, cancellation terms, and refund treatment will be stated in the applicable proposal or service agreement. We may suspend unstarted or ongoing work where payment, authority, access, or a required approval is outstanding, subject to the relevant agreement and applicable law.
7. Third-party vendors and professionals
We may recommend, coordinate with, or obtain services from contractors, cleaners, maintenance providers, photographers, legal professionals, accountants, banks, insurers, platforms, or other third parties. Their services may be subject to their own quotations, contracts, warranties, licences, insurance, and policies.
Where we coordinate a third party, we will do so within the agreed scope. The provider remains responsible for its own work, professional advice, products, omissions, and statutory obligations. Nothing in this section limits any responsibility West Haven has that cannot lawfully be excluded or is expressly accepted in a written agreement.
8. Communications and digital channels
You may choose to communicate with us through the website chat, email, telephone, or video call. These channels can be convenient but may involve third-party networks and platform terms. Do not send passwords, card data, one-time codes, or other highly sensitive information through an insecure channel.
We may rely on instructions received from contact details or authorised representatives identified in the relevant service agreement, subject to reasonable verification. Formal notices, approvals, and records may require a particular form or channel as specified in that agreement.
9. Acceptable use of the website
You may use the website only for lawful, personal, or legitimate business enquiries. You must not interfere with the website, attempt unauthorised access, introduce malicious code, scrape or reproduce content at scale, impersonate another person, submit false information, or use the website in a way that harms West Haven, its clients, or others.
We may restrict or suspend access where reasonably necessary to protect the website, users, or our business.
10. Intellectual property and third-party links
The West Haven name, turtle mark, website design, text, photographs, graphics, and other content are owned by or licensed to Westhaven Private Limited and are protected by applicable intellectual-property laws. You may view the website for personal or legitimate enquiry purposes, but may not copy, modify, publish, distribute, or commercially use its content without prior written permission.
The website may contain links to third-party sites or services for convenience. We do not control or endorse them and are not responsible for their content, availability, or practices.
11. Disclaimers, liability, and consumer rights
We aim to keep the website accurate, secure, and available, but it is provided on an “as available” basis. We do not promise that it will always be uninterrupted, error-free, or suitable for every purpose. We are not responsible for losses caused by reliance on general website content where a written service agreement or qualified professional advice was needed.
Any allocation of risk, exclusions, limits of liability, indemnities, insurance, or remedies for an engaged service will be set out in the applicable written agreement. Nothing in these Terms excludes or limits rights, remedies, or liabilities that cannot lawfully be excluded or limited, including rights available under applicable consumer-protection law.
12. Force majeure
We will not be responsible for a delay or failure caused by circumstances reasonably beyond our control, such as severe weather, flooding, civil disturbance, strikes, public-health events, governmental action, utility or communications failure, or an event affecting site safety or access. We will take reasonable steps to communicate material impacts and resume work when practical.
13. Governing law and disputes
These Terms are governed by the laws of India. Subject to any mandatory consumer or statutory forum available to you, courts in Thiruvananthapuram, Kerala will have jurisdiction over disputes relating to these Terms. Before starting formal proceedings, we encourage you to contact us so we can try to resolve the concern promptly and fairly.
14. Changes to these Terms
We may update these Terms to reflect changes in our website, services, or applicable law. The latest version will be posted here with the updated date. Continued use of the website after publication means you accept the revised Terms, to the extent permitted by law. Changes to an active service engagement will be handled under its written agreement.
